OnePass – Win a share of 20x million Flybuys points Competition 2023

1. The Competition is a game of chance and is authorised under the permits: ACT: TP 23/02413 SA: T23/1850, NSW: TP/02092

2. Information on how to enter forms part of the terms of entry. Entry into the OnePass –Win a share of 20 million Flybuys points (“Competition”) is deemed acceptance of these Terms and Conditions.

3. The material used to market and promote the Competition forms part of the Competition Terms and Conditions. If there is an inconsistency between the material used to market and promote the Competition and the Competition Terms and Conditions, the Competition Terms and Conditions prevail.

4. Promoter: The Promoter is Wesfarmers One Pass Pty Ltd (ABN 39 650 854 845) of Level 6, 699 Collins Street, Docklands, 3008, VIC and 1300 026 710 (“Promoter”).

5. Prize Facilitator: The Prize Facilitator is Flybuys and Flybuys will provide the Flybuys points to the winners of this Competition.

6. Ansible: Ansible Pty Ltd (ABN 86 097 086 390) (Ansible) a division of Mediabrands Australia Pty Ltd, have been appointed to facilitate the Competition and the computerised prize draw.

7. Catch: Catch is a OnePass participating brand and for the purposes of this Competition is supporting by offering bonus entries into the Competition (Catch.com.au Pty Ltd (ABN 22 149 779 939) of Level 6, 699 Collins Street, Docklands, VIC, 3008.

8. Target: Target is a OnePass participating brand and for the purposes of this Competition is supporting by offering bonus entries into the Competition ( Target Pty Ltd (ABN 75 004 250 944) of 2 Kendall St, Williams Landing, VIC 3027.

9. Kmart: Kmart is a OnePass participating brand and for the purposes of this Competition is supporting by offering bonus entries into the Competition (Kmart Australia Ltd (ABN 73 004 700 485) of 690 Springvale Rd, Mulgrave, VIC 3170.

10. Bunnings Warehouse: Bunnings Warehouse is a OnePass participating brand and for the purposes of this Competition is supporting by offering bonus entries into the Competition ( Bunnings Group Limited ABN 26 008 672 179) of Building 3, 570 Swan Street, Burnley, VIC 3121.

11. Officeworks: Officeworks is a OnePass participating brand and for the purposes of this Competition is supporting by offering bonus entries into the Competition ( Officeworks Ltd (ABN 36 004 763 526) of 1341 Dandenong Road, Chadstone, 3148.

Competition Period

12. The Competition commences on Friday, 1 December 2023 at 07:01 AEDT and closes on Sunday, 31 December 2023 at 23:59 AEDT (“Competition Period”).

13. The Competition will be advertised on, but not limited to https://onepass.com.au/

Eligibility to Enter

14. During the Competition Period, anyone may enter the Competition, provided that they:
a. are over 18 years of age;
b. are a resident of Australia;
c. are a valid current Flybuys member or a valid new Flybuys member who joins during the Competition Period (to be a valid Flybuys member the Flybuys member account must include the member’s first and last name, a valid postal address, a valid email address, and a valid contact phone number current at time of draw and prize distribution);
d. are not an employee or immediate family member of an employee, of the Promoter, of Kmart, Target, Catch.com.au, Bunnings Warehouse, Officeworks or the Prize Facilitator, who is directly associated and connected with the organisation of this Competition.

How to Enter

15. To participate in the Competition entrants must:
a. sign up to OnePass membership, as a free trial or paid, or be an existing OnePass member during the Competition Period, and have completed all required details as part of the sign-up process including, but not limited to, full name, e-mail address, mobile number, and payment details;
b. have your OnePass and Flybuys accounts linked during the Competition Period, to get one (1) automatic entry; c. maintain a Flybuys linked and paid OnePass membership until the draw on 7 February 2024;
d. to obtain bonus entries during the Competition Period you must meet the criteria in clauses 15(a), (b), (c) above and;
i. make purchases online at Catch.com.au during the Competition Period with a minimum spend of $25, and receive a bonus entry for every additional $25 spent e.g $50 spent receives 2 entries
ii. make in-store purchases at Kmart, Target, Bunnings Warehouse or Officeworks with a minimum spend of $25, and receive a bonus entry for every $25 spent e.g $50 spent receives 2 entries
e. at the time of the transaction, be logged into their OnePass account when checking out online at Catch.com.au, and swipe their Flybuys card in-store at Kmart, Target, Bunning Warehouse or Officeworks at time of purchase.

16. For clarity, all individuals who meet the Eligibility to Enter requirements under clause 14 and have successfully completed the How to Enter requirements in clause 15 will be deemed a valid entry (“Valid Entry”) and automatically entered into the Competition.

17. The Promoter reserves the right, at any time, to verify the validity of entrants (including a subscriber’s identity, age, and place of residence) and to disqualify any members who do not have a current membership to OnePass accordance with these Terms and Conditions or who tampers with the sign-up process. Error and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Drawing winners

20. The Prize Draw will be held on Wednesday, 7 February 2024 at 11:00 AEDT at Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills NSW 2010 via an electronic computerised draw.

21. The prize winners will be notified via phone or email by the Promoter within two (2) business days of the draw and the winners’ details including initial of first name and surname will be published on https://onepass.com.au/ from Monday, 12 February 2024.

22. Upon notification, the Promoter will provide the prize winner’s details to the Prize Facilitator within ten (10) business days of prize acceptance and the points will be automatically allocated to the winner’s Flybuys account 4 weeks after the prize draw date. If there any queries in respect to the points, contact Flybuys Customer Support Team on 13 11 16.

23. The Prize Facilitator will manage any winners’ personal information in accordance with its privacy policy https://experience.flybuys.com.au/policies/privacy-policy/

24. If for whatever reason any Prize is not claimed by the Prize Claim Deadline, or the entrant is deemed ineligible to enter the Competition and claim a Prize, a redraw will take place at Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills NSW 2010 on Wednesday, 28 February 2024 at 10:00 AEDT (“Unclaimed Prize Draw”). The prize redraw winner, if any, will be notified of their prize within two (2) business days by the Promoter via phone or email and the redraw winners’ details including initial of first name, surname and postcode will be published on https://onepass.com.au/ from Friday, 1 March 2024.

25. Once an Unclaimed Prize Draw winner has accepted their prize, the Promoter will provide their details to the Prize Facilitator within ten (10) business days of prize acceptance. Flybuys the points will be automatically allocated to the redraw winner’s Flybuys account 4 weeks from the Unclaimed Prize Draw date. If there any queries in respect to the points, contact Flybuys Customer Support Team on 13 11 16.

26. The Prize Facilitator will manage any redraw winners’ personal information in accordance with its privacy policy https://experience.flybuys.com.au/policies/privacy-policy/.

27. If the Prize is not claimed as part of this Unclaimed Prize Draw, the Prize Facilitator, in its sole discretion, will forfeit that Prize and no substitute will be offered.

Prize Details

28. There will be eleven (11) individual prize winners drawn from the Valid Entries.

29. The 20 million Flybuys points prize pool will be split into the following categories:
a. One winner to win 10 million Flybuys points – valued up to AUD $50,000.00
b. Ten winners to win 1 million Flybuys points each – valued up to AUD $5,000.00 each The total prize pool is valued up to AUD $100,000.00.

Winner Generated Content & Publication

30. In participating in Competition, the prize winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The prize winners grant the Promoter and Prize Facilitator a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the prize winners will not be entitled to any fee for such use.

31. The prize winners consent to having any content created be used in OnePass, and/or Prize Facilitator channels or platforms. 

32. The prize winners agree that they will not sell or otherwise make available their story and/or photographs to any media or other organization.

 

33. Force majeure

If there is a force majeure event which prevents or materially and adversely affects the Promoter’s ability to market, promote and run the Competition in accordance with the Competition terms, the Promoter may cancel, terminate, modify, suspend or postpone the Competition subject to state and territory licensing authorities approval.

34. Liability

Except as required under applicable law, neither the Promoter nor Prize Facilitator is liable for any loss, expense, damage or liability suffered or incurred by entrants or winners in connection with the Competition, including:
a. any late, lost, altered, damaged or misdirected information (when signing up to OnePass) or prize acceptance, including delays due to technical disruptions or network congestion;
b. any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the Competition;
c. any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure;
d. any theft, destruction, unauthorised access to or alteration of entries or the Prize; and
e. any use of the Prize or any tax liability incurred by the winner as a result of accepting the prize.
f. Nothing under this clause 34 is intended to limit a Prize winners’ rights under the Australian Consumer Law 2010.

35. Privacy & Contact

a. The Promoter collects personal information about entrants in order to run the Competition, communicate with you as the entrant to this Competition, administer and notify prize winners and prize fulfilment. The Promoter uses and manages entrants’ personal information in accordance with its OnePass Privacy Policy at https://onepass.com.au/privacy-hub/privacy-policy. The Promoter may provide entrants’ personal information to the Prize Facilitator for the purpose of fulfilling a prize winner’s prize. Your personal information may also be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
b. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, and first initial. If you do not want your information to be published, please contact OnePass Customer Support Team on 1300 026 710 during office hours. A request to access, update or correct any information should be directed to OnePass.
c. All queries, issues and concerns in connection with this Promotion are to be directed to the Promoter by completing the Contact Us form at https://support.onepass.com.au/s/customer-support or by calling the Promoter’s Customer Support Team on 1300 026 710 during office hours. All disputes are to be adjudicated by the Promoter.
